    I would like to know how this EU ruling affects the selling/transferring of a Vienna licence

    It must be recalled, next, that the copyright holder’s distribution right is exhausted, in accordance with Article 4(2) of Directive 2009/24, on the occasion of the first sale in the European Union by that rightholder, or with his consent, of any copy, tangible or intangible, of his computer program. It follows that, by virtue of that provision and notwithstanding the existence of contractual terms prohibiting a further transfer, the rightholder in question can no longer oppose the resale of that copy.

    License Transfers will be handled on a case-by-case basis as a special customer service. It will be necessary to announce a license transfer to us, and both you and the new licensee will have to agree to the license transfer. A nominal fee will be charged per transferred license.

    the above ruling implies otherwise.

  • That particular EU ruling applies to software, such as Vienna Ensemble and Vienna Suite, but not to sample libraries.

    Our approach on this topic is more on the practical side of things:
    We have found that monitoring each resale of our products is the only way to make sure that the new owner of the license gets all parts of the product (DVDs, packages, and of course the keys containing the correct licenses..). 

    Here are 4 reasons why this can be important: 

    • Products purchased with a student discount cannot be resold without paying the difference to the full price.
    • We´re also checking if a resold license makes sense for the new owner (e.g., Extended Library licenses will not work without a corresponding Standard Library License, a Special Edition PLUS license is not very useful without the corresponding "normal" Special Edition license).
    • The new user gets access to all product-related downloads and gets full support with all product-related questions. 
    • Upgrade prices are available for all registered users, so we have to keep track of all resales. 

    This way we can reduce misunderstandings and also attempts of fraud to a minimum, and both parties benefit from this approval by VSL.  

    Additionally, we are in personal contact with seller and buyer, so there´s always help available for any other questions that might pop up.
